RE: The tariff classification of C*Dry GL 01934 from France

Dear Ms. Neumann:

In your letter dated December 5, 2000 you requested a tariff classification ruling.

Samples and descriptive information were included with your request. The subject merchandise is C*Dry GL 01934 and is described as spray dried glucose obtained by the enzymatic conversion of starch. The product has a Dextrose Equivalent (DE) of 38, and contains dextrose, maltose, maltotriose and higher saccharides. It will be used as a food ingredient in baby foods, meats, ice creams, etc. The merchandise will be imported in bulk packaging.

The applicable subheading for the C*Dry GL 01934 dried glucose syrup will be 1702.30.4080, Harmonized Tariff Schedule of the United States (HTS), which provides for Glucose and glucose syrup, not containing fructose or containing in the dry state less than 20 percent by weight of fructose…other…other. The rate of duty will be 2.2 cents per kilogram. The rate of duty will remain unchanged in 2001.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
